Consent to Receive Electronic Communications

1. Your consent

By submitting your request on fundotter.com, you consent to receive all records, notices, disclosures, agreements and other communications from Fund Otter and from the lenders and other providers we direct you to ("Communications") in electronic form, rather than on paper. This consent is given under the federal Electronic Signatures in Global and National Commerce Act (E‑SIGN Act), and it applies to every Communication relating to your request.

2. Electronic signatures

You agree that clicking a button, ticking a box or otherwise submitting information on this Site is your electronic signature, and has the same legal effect as a handwritten signature on paper.

3. How we deliver Communications

  • By email to the address you provided.
  • By posting the Communication on this Site, where you can view, download and print it.
  • By SMS or text message, where you have separately agreed to be contacted that way.

It is your responsibility to keep the email address and phone number you gave us current, and to check them for Communications.

4. What you need in order to receive Communications

To receive and keep electronic Communications you need:

  • A computer or mobile device with an internet connection.
  • A current web browser that supports 128‑bit encryption, with cookies enabled.
  • A valid, active email account, and software able to open PDF files.
  • Enough storage space to save Communications, or a printer to print them.

If these requirements change in a way that creates a material risk that you could not access or keep your Communications, we will tell you.

5. Requesting paper copies

You may ask for a paper copy of any Communication we sent you electronically by emailing [email protected]. We do not charge a fee for this. Asking for a paper copy does not, by itself, withdraw your consent.

6. Withdrawing your consent

You may withdraw this consent at any time by emailing [email protected] with your name and the email address you used. Your withdrawal takes effect once we have had a reasonable time to process it, and it does not affect Communications sent before that. If you withdraw consent, we may be unable to process your request, and any lender you were directed to will handle its own communications under its own terms.

7. Updating your contact details

Tell us about any change to your email address or phone number by emailing [email protected].
